Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Evolution Dynamics LLC, doing business as Charge Home Solutions ("Charge Home Solutions," "we," "us," or "our"), governing your use of our website and the services we provide. By using our website, requesting an estimate, or purchasing services, you agree to these Terms. If you do not agree, do not use the website or services. Please read the arbitration and class-action-waiver section below, which affects how disputes are resolved.

Who we are and what we do

Charge Home Solutions coordinates residential and commercial electrical, EV charging, and energy-storage services delivered by licensed, insured electricians. All electrical work is performed by professionals holding the licenses required in the applicable jurisdiction, and is subject to local permitting, code, and inspection requirements.

Our role and responsibility for the work

Except where we expressly agree in writing to perform work ourselves, Charge Home Solutions acts as a coordinator that connects you with an independent, licensed, and insured electrician or contractor. The assigned electrician is an independent professional and is solely responsible for their own licensing, insurance, tools, workmanship, safety, code compliance, and the results of the work they perform.

Where you contract with and pay the electrician directly, your agreement for the work is with that electrician, and they, not Charge Home Solutions, are responsible for the work and for any claim arising from it. Our responsibility is limited to the coordination and any services for which you pay Charge Home Solutions directly, and to the express written warranty (if any) we provide for those services. This allocation of responsibility does not limit any right you have that cannot be waived under applicable law, including rights relating to bodily injury caused by negligence.

Independent contractor relationship

The electricians and contractors in our network are independent contractors, not employees, agents, partners, or joint venturers of Charge Home Solutions. Charge Home Solutions does not supervise, direct, or control the means and methods used by independent electricians in performing their work, and is not responsible for their payroll, taxes, benefits, employment status, or day-to-day supervision.

Each independent contractor is solely responsible for complying with all applicable laws, licensing requirements, insurance obligations, OSHA and workplace-safety standards, electrical and building codes, permitting requirements, and manufacturer installation instructions. Charge Home Solutions' role is to coordinate, schedule, and facilitate customer service, except where it expressly agrees in writing to perform work directly.

Eligibility and acceptable use

You must be at least 18 years old and able to enter a binding contract. You agree to use the website only for lawful purposes, to provide accurate information, and not to interfere with the site's operation, security, or other users.

Estimates, quotes, and pricing

Prices, ranges, and savings figures shown on the website or in marketing are general information and illustrative only; they are not offers and are not binding. Your binding price is the written estimate we provide after assessment of your specific site and requirements. Rebate and incentive figures are addressed in the Rebates, incentives, and tax credits section below.

Scheduling, permits, and your responsibilities

Timelines are estimates and may be affected by permitting, utility coordination, inspection scheduling, supply availability, site conditions, and other factors. You are responsible for providing accurate information, safe and timely access to the work area, and disclosure of known conditions (for example, prior wiring issues, hazardous materials, or concealed defects). Additional conditions discovered during work may change scope and price, which we will communicate before proceeding.

Payment

Payment terms are stated in your written estimate or invoice. Amounts are due as agreed. Late or unpaid amounts may accrue interest and collection costs to the extent permitted by law.

Warranties and disclaimer

The workmanship warranty applicable to your project is as described in your written estimate and our Warranty page, and is provided by the assigned electrician and/or Charge Home Solutions as stated there. Equipment and hardware carry the manufacturer's warranty, not ours. Except for the express written workmanship warranty we provide, and to the fullest extent permitted by law, the website, information, and services are provided "as is" and "as available," and we disclaim all other warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow certain disclaimers, so some of these may not apply to you.

Customer inspection and acceptance

You agree to inspect all completed work promptly upon completion. Any visible issue must be reported to us within seven (7) days of completion. Failure to notify us of a visible defect within that period constitutes acceptance of the completed work, except where prohibited by law. This does not waive any applicable express written workmanship warranty for defects that are not reasonably visible on inspection.

Concealed and pre-existing conditions

Existing electrical systems and structures may contain concealed defects, outdated or improper wiring, code violations, overloaded or undersized circuits, damaged or deteriorated equipment, or other hazardous conditions that are not reasonably discoverable during an initial assessment. Discovery of such conditions may require additional work, time, and charges, which we will communicate before proceeding where practicable.

Existing equipment and future failures

Existing electrical equipment, including panels, meters, breakers, and wiring, may fail during or after work due to age, deterioration, prior damage, improper installation by others, manufacturing defects, or pre-existing conditions. Charge Home Solutions and the assigned electrician are not responsible for failures that are unrelated to their own workmanship.

Pre-existing damage and property

We are not responsible for pre-existing damage, or for damage not caused by our negligence, to drywall, stucco, paint, flooring, cabinetry, landscaping, driveways, concealed or underground utilities, or other property. Some access, cutting, and patching may be necessary; the scope of any patching or restoration is as stated in your written estimate.

Hazardous materials

We do not test for, identify, remove, or remediate asbestos, mold, lead paint, contaminated soil, hazardous waste, or other environmental or hazardous materials. If such materials are encountered, work may be paused until they are properly addressed by a qualified party at the customer's expense.

Customer-supplied equipment

Where you supply equipment yourself (for example, a customer-purchased Tesla Wall Connector, charger, battery, or panel), Charge Home Solutions and the assigned electrician are not responsible for that equipment's failures, defects, compatibility issues, missing parts, delays, or warranty claims. Warranty for customer-supplied equipment is between you and the manufacturer or seller.

Manufacturer and brand independence

Charge Home Solutions is an independent installer. We are not owned or operated by, and do not act as an agent of, Tesla, Ford, Rivian, GM, ChargePoint, Wallbox, Enphase, or any equipment manufacturer or brand, unless expressly stated in writing. References to brands or certifications describe the products we install and the training our electricians hold; they do not imply endorsement, agency, or a joint venture.

Product warranties

All product and equipment warranties are provided solely by the manufacturer, on the manufacturer's terms. Charge Home Solutions does not extend, modify, assume, or guarantee any manufacturer warranty. Only warranties expressly stated in writing by Charge Home Solutions or in your written estimate apply to our services.

Delays and events outside our control

We are not responsible for delays or failures caused by events beyond our reasonable control, including utility companies, authorities having jurisdiction (AHJs), permitting offices, inspectors, utility approval or interconnection processes, supply or labor availability, weather, or acts of government. Timelines are estimates only.

Permits and additional work

Permits obtained for a project are for that project and property and remain with the project. If an authority having jurisdiction, inspector, or utility requires additional work, upgrades, or changes not included in your original estimate, that work will be quoted separately and requires your approval before it proceeds.

Access and readiness

If, at a scheduled appointment, you are not present, deny access, or the site is not ready for the work, a trip charge or rescheduling fee may apply as stated in your estimate or invoice.

Customer representations and responsibilities

By requesting service, you represent that: the electrical system and work area are safe to access; there are no known hidden hazards you have not disclosed; all information you provide is accurate; and all owners or decision-makers with authority over the property have approved the requested work.

No guarantee of savings or results

We do not guarantee any specific reduction in electricity or charging costs, utility bills, home value, tax savings, energy independence, backup duration, charging speed in all conditions, or return on investment. Actual results depend on your usage, rates, equipment, utility, incentives, and other factors outside our control.

Rebates, incentives, and tax credits

Rebates, incentives, and tax credits may change, be reduced, be exhausted, or expire without notice, and depend on program rules and your eligibility. Charge Home Solutions does not guarantee the availability, amount, approval, timing, or payment of any rebate, incentive, or tax credit, and does not provide tax advice. Confirm all figures with the applicable program and your own tax advisor.

Photographs and documentation

You authorize photographs and documentation of the work area before, during, and after the work for documentation, quality assurance, warranty administration, training, and dispute resolution. We will not publicly disclose information that personally identifies you without your permission.

Website accuracy and automated tools

While we strive for accuracy, we do not guarantee that website content is complete, current, or error-free, and it may change without notice. Information generated by calculators, AI assistants, rebate or savings tools, or other automated systems is informational only and is not legal, tax, engineering, or financial advice; do not rely on it as a substitute for professional advice or a written estimate.

Electronic communications and text messages

By contacting us, submitting a form, or requesting service, you consent to receive communications from us and our vendors by phone, email, SMS/text, and automated scheduling notifications regarding your inquiry and services. Message frequency varies, and message and data rates may apply. Consent to texts is not a condition of purchase. Reply STOP to opt out of texts and HELP for help.

Website availability and security

The website is provided on an "as available" basis. We are not responsible for interruptions, errors, or losses caused by internet or network outages, software failures, cyber incidents, or third-party technology providers.

Billing disputes and chargebacks

Before initiating a chargeback or payment dispute, you agree to first contact Charge Home Solutions so we can resolve the issue. Filing a chargeback for services properly performed may result in collection efforts and recovery of costs to the extent permitted by law.

Time to bring claims

To the extent permitted by law, any claim arising out of or relating to the services or these Terms must be commenced within one (1) year after the cause of action arises, or it is permanently barred.

Attorneys' fees

To the extent permitted by applicable law, the prevailing party in any dispute arising out of or relating to these Terms is entitled to recover its reasonable attorneys' fees and costs.

Limitation of liability

To the fullest extent permitted by law, Charge Home Solutions and its owners, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the website or services, even if advised of the possibility. To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services will not exceed the amount you paid to us for the specific service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or bodily injury caused by our negligence.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Charge Home Solutions from third-party claims, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of law, or inaccurate information or unsafe conditions you failed to disclose.

Dispute resolution, arbitration, and class-action waiver

Please read this section carefully; it affects your legal rights. You and Charge Home Solutions agree that any dispute arising out of or relating to these Terms, the website, or the services will first be addressed informally by contacting us. If not resolved, the dispute will be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer rules, rather than in court, except that either party may bring an individual claim in small-claims court. You and Charge Home Solutions waive the right to a jury trial and agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding. This section does not apply to the extent prohibited by applicable law.

Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules, except where the law of your state of residence applies and cannot be waived. Subject to the arbitration section, the exclusive venue for any permitted court action is the state or federal courts located in Florida, and you consent to their jurisdiction.

Website content and intellectual property

The website's content, design, and marks are owned by us or our licensors and are protected by law. You may not copy, reproduce, or use them without permission. Information on the site is for general purposes and is not professional, legal, or tax advice.

Changes, severability, and entire agreement

We may update these Terms from time to time; changes take effect when posted, and continued use constitutes acceptance. If any provision is held unenforceable, the remaining provisions stay in effect. These Terms, together with your written estimate and our posted policies, are the entire agreement between you and us regarding their subject matter.
